American Waiting For WTO Ruling — High Convention Hdg Solar Roof Mounting System

Overview:The World Trade Organization (WTO) committee ruled that the United States imposed anti-dumping duties on Chinese photovoltaic products in violation of WTO rules. In addition, the U.S. judge's ruling in a case involving China's Sany Heavy Industries Wind Power Project in Oregon is in Sany Heavy Industries'favor. These two coincidental rulings have nothing to do with time, but have boosted China's wind and photovoltaic companies.

The World Trade Organization (WTO) committee ruled that the United States imposed anti-dumping duties on Chinese photovoltaic products in violation of WTO rules. These two coincidental rulings have nothing to do with time, but have boosted China's wind and photovoltaic companies.


To be sure, the dispute will not be stopped. However, the WTO ruling on photovoltaic products may mean a tough battle for the United States.


According to the US authorities, Chinese photovoltaic enterprises have been unfairly subsidized by the government in many ways, such as using government land, obtaining low-interest loans from state-owned banks, tax incentives and so on, so they have decided to impose punitive tariffs on Chinese photovoltaic products.


The WTO ruling does not dispute the US authorities'claim of unfair government subsidies, but it finds that some of the procedures involved are problematic. Simply put, the WTO believes that such anti-dumping duties can only be levied by the state if it proves that the enterprises involved are wholly or partially state-owned. Since most of China's large photovoltaic enterprises were initially private enterprises supported by venture capital, they have now developed into large listed enterprises, which makes the U.S. ruling somewhat problematic.

The WTO ruling could force the U.S. authorities to seek a negotiated solution, which may be good news for the entire photovoltaic industry. Such agreements can maintain strong global competition and benefit almost everyone, which is also one of the key factors driving the development of the photovoltaic industry.


In addition, U.S. judges ruled that the Obama administration's failure to approve Sany Heavy Industries Wind Power Project on the grounds of national security concerns was not transparent. The lawsuit began two years ago and the latest ruling overturned the lower court's decision to support the Obama administration. The judge argued that the obscure reasons for the Obama administration's rejection of the relevant projects were overwhelming.


There have been reports suspicion that the project is located near a defense plant that manufactures high-tech UAVs, leading US authorities to fear that the project involves espionage.
